A Poor Example

Social media was having a good chuckle at this earlier today.

But as it turns out, it’s a bit more than just an embarrassment.

There’s no law against a former First Minister and current MSP shilling for his wife’s therapy business on the internet, even if some people might think there should be.

But Humza Yousaf’s wife Nadia El-Nakla is also an SNP councillor in Dundee.

And public servants shouldn’t break the laws that DO exist.

El-Nakla is advertising the £65 session as “women-only”. And the recent Supreme Court ruling in the For Women Scotland case was very clear indeed that services billed as being for women only had to mean biological women, or they would be in breach of the Equality Act 2010.

And that isn’t what El-Nakla means.

As very politely and concisely explained to El-Nakla by a number of people, a women-only event including men who self-identify as transwomen, but excluding men who don’t, is unlawful discrimination against the latter group of men.

Her professional body, the British Association for Counselling and Psychotherapy (BACS) issued a statement in the wake of the Supreme Court ruling which asserted its ongoing support for “the trans community”, but nevertheless accepted unequivocally that the ruling meant transwomen were not entitled to access single-sex spaces or services for women – even if they had a Gender Recognition Certificate, which the vast majority don’t and which the service provider isn’t allowed to ask for anyway.

Humza Yousaf’s workplace, where he was also once the Cabinet Secretary for Justice, has also acknowledged (and correctly acted on) the law.

So there’s no grey area, no doubt, and no wiggle room here. Nadia El-Nakla CANNOT lawfully offer a “women only” therapy session and then allow some biological males (but not others) into it. It must admit ALL men, or none.

It is plainly not acceptable for two taxpayer-funded elected representatives to advertise a law-breaking commercial venture, unless the law and judiciary of Scotland and the UK are intended to be held in even more public contempt than they already are. We await developments with interest.
